To strengthen the standardization and guidance of internal rules and regulations within employers and to promote the effective implementation and detailed enforcement of the "Law of the People's Republic of China on the Protection of Women's Rights and Interests" in the workplace, the Ministry of Human Resources and Social Security, the National Health Commission, the Supreme People's Procuratorate, the All-China Federation of Trade Unions, the China Enterprise Confederation/China Entrepreneurs Association, and the All-China Federation of Industry and Commerce recently jointly issued the "Special Labor Protection System for Female Employees in the Workplace (Reference Text)" and the "System for Eliminating Sexual Harassment in the Workplace (Reference Text)."
The “Special Labor Protection System for Female Employees in the Workplace (Reference Text)” consists of 7 chapters and 26 articles. In a concise and clear format, it outlines key provisions covering labor and employment protection, wage and welfare protection, maternity protection, and occupational safety and health protection for female employees in the workplace. At the same time, to ensure the normal production order in the workplace, it provides standardized guidelines for fulfilling the required procedures.
The “System for Eliminating Sexual Harassment in the Workplace (Reference Text)” consists of 7 chapters and 20 articles, clearly defining key aspects such as the definition and main manifestations of sexual harassment, public commitments, publicity and training, employee reporting and complaints, investigation and handling procedures, and trade union involvement in supervision. At the same time, it guides employers to maintain confidentiality regarding complainants and those involved in investigation and handling, paying close attention to protecting individuals’ right to privacy and taking measures—such as adjusting job assignments—to prevent secondary harm to victims.
According to the introduction, the two reference texts serve as crucial vehicles and effective means for translating “the law as enshrined in statutes” into “law in practice.” They provide operational guidelines for employers to convert legal language into specific behavioral norms that are easy for employees to understand, readily grasp, and effectively implement, thereby helping to bridge the “last hundred meters” in ensuring the effective implementation of laws.
